CHANGES AND CANCELLATION
a) Changes to the Event
The Patron shall, on a timely basis, notify the Hotel of any changes to the guaranteed attendance
and/or guestroom and function space requirements for the event. All changes are subject to
availability, and all agreed-upon changes must be confirmed by the Parties in writing prior to the
event.
Any changes resulting in a reduction of the total guaranteed revenue to the Hotel shall be subject
to cancellation or attrition fees. The amount of such fees to the Hotel owing shall vary according to
the number of days prior to the event (as set out in the table below) that the Hotel is notified of such
changes.
b) Rates of Fees for Full or Partial Cancellation
Partial or full cancellation of the event or otherwise failure to take up rooms in a room block would
result in the Hotel suffering losses equivalent to the profits that the Hotel would have earned from
the sale of rooms, food and beverage, and use of recreation facilities, etc. in connection with the
event.
The Parties acknowledge that as it is difficult to quantify those damages, the Patron has agreed
that the Hotel shall impose a cancellation fee, (the “Cancellation Fee”) against the Patron as
liquidated damages and not as a penalty.
c) “Lost Revenue” is defined as the sum total of anticipated revenue prior to the attrition and/or
cancellation, from rooms, food and beverage functions and recreation facilities commitments which
are canceled in full or in part by the Patron or which the Patron fails to take up at the time of the
event.
d) Payment of Cancellation Fee
In the case of a full cancellation, the cancellation fee is payable within 30 days of the presentation
of the invoice.
